That line sounds like trivia. It isn’t. A regular drug gets 5 years of market exclusivity before generics can apply. A biologic gets 12 years, its copycats face a far harder “biosimilar” approval process, and — the part nobody puts in the headlines — biologics are not eligible for pharmacy compounding at all. Classification is destiny: it decides when competition arrives, what it costs, and which doors are legally open.

Retatrutide’s backbone is 39 alpha amino acids, with a small side chain attached — a gamma-glutamate and a linker molecule. Lilly’s position: count everything attached and you get 41, so it’s a protein. The FDA’s position: the rule says alpha amino acids, the side chain doesn’t count, and 39-to-40 is not “more than 40.” One pharmacy law expert called it “a billion-dollar question that is hinging on the word ‘alpha.'” She’s underselling it.

The timeline matters. Lilly asked the FDA for biologic status in November 2023. The FDA said no in March 2024. Lilly sued that September. In September 2025, a federal judge split the decision down the middle: the FDA wins the amino-acid count — the rule means what it says — but the judge threw out the FDA’s refusal to even consider Lilly’s fallback argument, that retatrutide is “analogous to a protein.” The judge’s words: the agency’s bright-line approach “flouts the statutory text and sidesteps congressional intent.” That question went back to the FDA, which — a year later — still hasn’t answered it. Lilly appealed the part it lost. The Seventh Circuit heard arguments on September 24. We’re waiting on the ruling now.

And while that plays out, Lilly is fighting on a second front: a wave of lawsuits against companies selling retatrutide today — 11 filed since August. Read those two facts together and the strategy is plain. Win the classification case and retatrutide is locked up for 12 years with no compounding door. Win the seller cases and the unofficial market gets cleared in the meantime. Either way, the goal is the same: when this drug launches, Lilly wants to be the only door.

Here’s my honest read, and it cuts both ways. Lilly built this molecule and ran the trials; nobody serious disputes they earned a period of exclusivity — that’s the deal that funds the research. But seven extra years and a closed compounding door, won on a counting technicality, isn’t about rewarding innovation. It’s about delaying the day patients get a cheaper option. And a ruling for Lilly wouldn’t just affect one drug: it would blur the 40-amino-acid line that half the peptide world is classified by.

What to watch: the Seventh Circuit ruling, and whether the FDA ever answers the “analogous” question it was ordered to revisit. I’ll update this post when either lands. Until then, retatrutide remains what it’s been all along — the best weight-loss data ever published, still not FDA-approved, and now the subject of the most interesting court fight in the industry.

Read the trial before you buy the vial.
